Binigyang linaw ng Kataas-taasang Hukuman ang patungkol sa pagpili ng susunod na Punong Mahistrado.
Ayon kay Supreme Court Spokesperson Atty. Camille Sue Mae Ting, ang pangulo ng Pilipinas ay may kapangyarihan magtalaga ng panibagong Chief Justice ng Korte Suprema.
Maaaring pumili ang kasalukuyang lider ng bansa na si Pangulong Ferdinand ‘Bongbong’ Marcos Jr. sa hihirangin Punong Mahistrado.
Subalit ang pagpili aniya ay magmumula sa listahan ng mga nominado na inihanda ng JBC o Judicial Bar and Council.
Dapat umanong mapunan ang nabakanteng posisyon sa Korte Suprema sa loob ng 90 araw alinsunod sa Article VIII, Sections 4 at 9 ng konstitusyon.
“Under Article VIII, Sections 4 and 9 of the Constitution, a vacancy in the Supreme Court must be filled within 90 days. The President appoints the Chief Justice from a list of nominees prepared by the Judicial and Bar Council (JBC),” ani Supreme Court Spokesperson Atty. Camille Sue Mae Ting.
Habang base raw sa nakagawian ng Judicial and Bar Council, ang limang ‘most senior Associate Justices’ ng Korte Suprema ay inimbita upang magsumite ng aplikasyon sa posisyon pagka-Chief Justice bilang mga ‘preferred candidates’.
Sa darating na ika-6 ng Nobyembre nakatakdang magretiro mula sa puwesto si Chief Justice Alexander Gesmundo sa edad na 70.
Kaya’t si Senior Associate Justice Marvic MVF Leonen muna ang magsisilbing ‘Acting Chief Justice’ batay sa batas nagsasabing ‘most senior associate justice’ ang dapat humalili.
“This is pursuant to Section 12 of Republic Act No. 296, or the Judiciary Act of 1948, which provides that when the position of Chief Justice is vacant, the duties and powers of the Chief Justice shall be exercised by the most senior Associate Justice until a new Chief Justice is appointed and qualified,” ani SC Spokesperson Atty. Ting.
